Terms of Use
These Terms of Use (“Terms”) govern your use of the OpenTest website at opentest.online (“OpenTest”, “we”, “us”). By accessing or using the site, you agree to these Terms. If you do not agree, please do not use the site.
1. About OpenTest
OpenTest is an independent study tool to help you prepare for the New Zealand Road Code theory test. It is not an official testing service and is not affiliated with, endorsed by, or connected to NZTA / Waka Kotahi. The questions here are for practice only. For anything that affects your licence or legal obligations, always check the current New Zealand Road Code and NZTA’s official guidance.
2. Our content and intellectual property
All content on OpenTest is created by us. This includes, without limitation, the practice questions and answer options, answer explanations, illustrations, diagrams and icons, distilled study notes and knowledge pages, the learning map, page text, layout, design and source code (together, the “Content”).
The Content is our original work. We author our own questions, write our own explanations, and draw our own illustrations. The underlying road rules and factual information are, of course, public and belong to no one; but the specific way we express, select, organise, word and illustrate them is our own intellectual property, protected by copyright and other laws. All rights are reserved.
3. What you may do
- Access and use OpenTest for your own personal, non-commercial study;
- Practise as a guest or with a free account;
- Share links to our pages.
4. What you may not do
Except with our prior written permission, you must not:
- Copy, reproduce, republish, redistribute, sell, rent or sublicense any part of the Content or the question bank;
- Scrape, crawl, harvest, spider or use bots or automated tools to extract or download the Content;
- Frame, mirror or systematically download the site or any substantial part of it;
- Create derivative works from the Content, or incorporate it into another app, website, book or product;
- Use the Content to train, fine-tune or build machine-learning or AI models, or to build a competing service;
- Remove, obscure or alter any copyright, trademark or ownership notice;
- Interfere with the security or normal operation of the site.
5. Accounts
If you create an account, you are responsible for the information you provide and for activity under your account. Please give accurate details and keep your credentials secure. See our Privacy Policy for how we handle your data.
6. No warranty — practice only
OpenTest is provided “as is”, for practice and study. While we work hard to keep the Content accurate and current, we do not guarantee that it is complete, error-free or up to date with the latest official rules. Using OpenTest does not guarantee that you will pass any official test. Always rely on the official Road Code and NZTA for the final word.
7. Limitation of liability
To the extent permitted by law, OpenTest is not liable for any loss or damage arising from your use of, or inability to use, the site or its Content, including any reliance on the practice material.
8. Protecting our rights
We actively protect our copyright and other rights. Unauthorised copying, scraping or redistribution of our Content is a breach of these Terms and may infringe copyright law; we may take action, including technical measures and legal remedies, to stop it. If you believe any content on OpenTest infringes your rights, or you wish to request permission to use our Content, contact us and we’ll respond promptly.
9. Changes
We may update these Terms from time to time. We’ll change the “last updated” date above when we do. Continued use of the site means you accept the updated Terms.
